Each year people come to the United States seeking protection because they have suffered persecution or because they fear persecution for their:

Requirements
You can only apply if you are physically present in the United States and are not a US citizen.
​
If you are eligible for asylum, you may be allowed to remain in the United States. To apply for affirmative asylum or defense of asylum, file Form I-589, Application for Asylum and for Withholding of Removal, within one year from the date of arrival in the United States.
​
You may include in your affirmative asylum or asylum defense application your spouse and children who are physically present in the United States as dependents at the time you file or at any time before a final decision is made on your application. To include your child on your claim as a dependent, your child must be under 21 years of age and unmarried.

Types of Asylum

» affirmative asylum: It is a request that can only beeding for people who are not in deportation proceedings.
» Defensive Asylum: If for any reason USCIS does not approve your asylum application, you must apply for asylum through a defensive process

Suggestions for your statement the testimony
​
Your written statement must explain in detail why you left your home country and why you are afraid to return there.
​

Explain the persecution you experienced and/or the persecution you fear will occur in your country, and why you are or will be persecuted.

Be sure to describe how the persecution is due to or related to your race, religion, nationality, membership in a particular social group, and/or because of your political opinion.

Describe everything that happened to you in your country that made you leave the country.

Explain what you fear will happen to you if you return and explain who/what group you are afraid of.

Include any incidents that represent your fears, such as incidents of threats, warnings, attacks, violence and/or any other harm, etc.

Include descriptions of incidents or goals from other family members or even friends if they face similar risks or are similar to you in your situation.

Explain why you cannot move to any other part of your country to be safe, and explain why the government or law enforcement cannot, will not, or did not help you.

Somewhere at the beginning or end of your statement, be sure to include the following sentence:

"I declare under penalty of perjury under the laws of the United States that the foregoing is true and correct."

Newspaper clippings, affidavits from experts and witnesses, medical or psychological records, photographs showing beatings, personal diaries, official documents such as arrest records, any document containing threats, membership cards for a particular political party, personal statements from the applicant for asylum in the form of a letter, etc.
