Family Petition

If you are a US citizen or resident, you can apply for certain members of your family to obtain lawful permanent residence (Green Cards).
​

When the applicant petitions a relative, the following categories will be taken into account:


FAMILY PREFERENCES


» immediate Minor children, spouses, and parents ofAmerican citizens. These people will be able to adjust their status even if they are out of status, as long as they have entered legally.
»F-1Unmarried older sons and daughters of American citizens
»F-2A Husband and children underPermanent Resident
»F-2B Unmarried children 21 years of age or older thanPermanent Resident

If your family member is outside the United States, after you make your request, the family member must file a ProcessI am consular through the Embassy.


1. I-130 petition for a foreign relative.

2. Supplemental information for the I-130A beneficiary spouse (only when the petition is between spouses)

3. Any document that proves the relationship between the petitioner (marriage and divorce certificate (IF APPLICABLE)), birth certificate.

4. Copy of the Document that demonstrates the immigration status of the petitioner: Passport, Birth Certificate, Naturalization Certificate, permanent residence.

5. Two passport size photos of the beneficiary and the beneficiary

​Forms needed to apply for a ffamily member who is in the Country:


1. Petition for Alien Relative Form I-130.
2. Supplementary information for the beneficiary spouse. (only when the petition is between spouses) Form I-130A
3. Application to Register Permanent Residence or Adjust Status Form I-485.
4. Application for Employment Authorization Form I-765.
5. Affidavit of Economic Support Form I-864.

» Copy of Passport.
» Copy of driver's license.
» Documents that establish the petitioner / beneficiary relationship: birth certificate, certificate of  marriage, copy of Divorce certificate (if applicable).
» Taxes of the last years.
» Two passport size photos (if the request is between spouses).

 

Supporting documents of the beneficiary:


» Copy of Passport.
» Copy of the American Visa.
» Copy of I-94.
» Copy of birth certificate

» Divorce Certificate (IF APPLICABLE)
" Medical exam
» Four Passport Photos
» Affidavit of Support Form I-864

How Long Does a Petition for Relatives Take?
​

The deadline to process an I-130 petition depends on the relationship that you and your family have shown at the USCIS offices. However, the approximate time can be between 6 to 12 months.
