Adjustment of Status
Adjustment of immigration status is the process in which an immigrant within the United States can apply for a Green Card and obtain legal permanent residence.

If the immigrant is in the US, they can obtain a Green Card without the need to return to their country of origin.
On the other hand, if the immigrant is outside the US, they can obtain a visa through the consular processing.

Generally, you must have a valid visa to make an adjustment of status or a change of immigration status.
It is not possible to submit an application if you do not have legal immigration status in the US.

The first step is to check if you are eligible to apply for a Green Card under any type of category.
These categories vary depending on the type of immigrant who requests it.

» 2. You Or Someone Else Can File An Application On Your Behalf
Usually most people file 2 forms. On the one hand, an immigrant petition and at the same time the application for the Green Card (Form I-485).
Most commonly, someone presents the petition to the beneficiary, usually as sponsorship.
The most common forms in these cases are the following:

Form I-130, Petition for Alien Relative.

Form I-140, Immigrant Petition for Alien Worker.

Form I-730, Refugee/Asylee Relative Petition.

In other circumstances, other requests include the following documents:

The vast majority of categories require an approved immigrant petition before Form I-485, Application to Register Permanent Residence or Adjust Status, can be filed, however, in certain cases the applicant can advance both applications simultaneously.

You cannot apply for a Green Card if a visa is not available.
