How can I help my children become Permanent Residents of the United States?

​

  • US citizens by birth or naturalization may petition their immediate family members and others. 

  • They can do this by sponsoring the relative through a foreign relative petition and demonstrating that they can support them financially. 

  • To do so, they must present evidence of sufficient income and/or assets.

  • Family members are categorized into Immediate and Non-immediate. This benefits the priority date for the availability of visa slots for these relatives.

  1. Unmarried children under 21 years of age : 

​

  • first preference. Corresponds to sons/daughters over 21 years of age, single, of American citizens.

  • Second preference (2A). Group the spouse of a permanent resident (Holder of a Green Card, and unmarried children under 21 years of age.

​

  1. ​2. Unmarried Adult Children: 

​

  • Second preference (2B). Includes adult and unmarried sons and daughters, holders of a residence card.

​

  1. 3. Married Children :

​

  • Third preference. Married sons/daughters, regardless of age, of American citizens.

​

The process

 

  • Filing Form I-130, Petition for Alien Relative. The form establishes the relationship between the family member and the petitioner. 

  • The foreign relative who is outside the US will have to wait in their country of origin to be able to emigrate legally.

  • If you are already in the US, then you can adjust your status to permanent resident.

​

Petitions from relatives living abroad are sent to the National Visa Center (NVC). After processing the petition, the NVC forwards it to the US consulate in the appropriate country. At that moment the call begins consular process.

​

What happens after the I-130 is approved?

​

If you are an immediate relative, such as a parent, spouse, or unmarried child under the age of 21, you can apply immediately (Adjustment of Status).

  • US Birth Certificate 

  • Valid US passport

  • naturalization certificate

  • citizenship certificate

  • Consular Report of Birth Abroad

»If the Petitioner is a Permanent Resident 

​

  • Green Card (Green Card)

  • A passport issued in another country and stamped for temporary permanent residence in the United States

​

»Add the following documents:

  • Tax return of the last 3 years

  • Child's Birth Certificate (to prove family)

  • 2 passport style photographs

  • Marriage Certificate (if any)

  • Divorce Certificate (if any)

Supporting Documents for I-130 (Beneficiary)

 

  • Marriage Certificate (if married)

  • Passport of the Son 

  • Wife's Passport (if married)

  • Passport of the children (if you have them)

  • Children's Birth Certificate

  • Form I-94 (if any)

  • 2 Passport-style photographs (of the Child, Spouse, and Grandchildren)

​

If the Beneficiary is in the United States, Adjustment of Status is requested

​

  • Birth certificate issued in another country

  • Passport issued in another country

Proof of Entry and Legal Status

  • US visa

  • I-94 Trip Record

  • Judicial, police, or prison records

If the Beneficiary is outside of the United States, a Consular Process is required

The beneficiary must present:

Nationality Proof

  • Birth certificate issued in another country

Previous Marriage Completion Proof​

  • DD-214 (if you served in the US military)

  • Other US military service records

  • Military service records from a country other than the United States

Supporting Documents for Financial Support (I-864)(Petitioner)

​

Proof of ability to financially support a spouse 

​

  • Copy of your most recent US federal income tax return

 - Additionally, these documents can strengthen your application with:

  • Copies of your US federal income tax returns for the last 3 years

  • Pay stubs for the last 6 months

  • Letter from your employer to show proof of employment

  • Proof of ownership of stocks, bonds, certificates of deposit (CDs), or other investment account

  • Bank statements

 - If you use your home:

  • Ownership document (such as title or deed)

  • A recent appraisal by a licensed appraiser or a recent tax assessment

  • A document showing the amount of each loan secured by a mortgage, deed of trust, or other lien on the home

 

 - If you use your second vehicle:

  • Document of ownership (such as title or deed) for all vehicles, including the one you are listing as an asset

  • A recent appraisal by a licensed appraiser or a statement from the dealer indicating the current value of the vehicle.

  • Sponsoring spouse, financial co-sponsor (if applicable), and spouse seeking a green card

Proof of entry and legal status in the US

  • I-94 Trip Record

  • valid US visa

  • Passport issued in another country

Proof of pending marriage-based green card application

  • Notice of receipt ( Form I-797C) You need it if you are married to a Permanent Resident

​

Proof of prior authorization to work in the United States

​

proof of nationality

  • Birth certificate and photo ID

  • Visa issued by the consulate of a country other than the United States

  • Another national identity document with your photo and/or fingerprint

​

proof of identity

  • Two 2-inch by 2-inch passport photos 

​

Supporting Documents for Travel Permit (I-131) (Beneficiary)

​

Proof of identity (must show your name, date of birth, and photo)

  • Green card

  • Passport (photo page only)

  • Current work permit, if available

  • Valid government-issued driver's license

​

​

Proof of current immigration status

  • valid US visa

  • Any other document issued by the US Citizenship and Immigration Services (USCIS) that shows your current status, if any, in the United States (such as Form I-797 or "Notice of Action")

​

Proof of pending marriage-based green card application

  • Notice of Receipt (Form I-797 C)

​

Additional proof of identity

  • Two 2 x 2-inch passport photos

​
